1. Agreement
By using the Elendil Studio website (elendilstudio.co.uk) or by engaging us for any project or service, you agree to these Terms of Service. If you do not agree, please do not use our site or services.
2. Use of the website
You may use our website for lawful purposes only. You must not use it to transmit harmful, offensive, or illegal content, or to attempt to gain unauthorised access to our or any third party’s systems or data. We may suspend or restrict access if we believe you have breached these terms.
3. Services and contracts
Specific projects (e.g. web design) are governed by the quote, proposal, or contract we agree with you. That document will set out scope, deliverables, pricing, payment terms, and ownership of work. In the event of conflict between these Terms and a signed contract, the contract prevails for that project.
4. Intellectual property
Unless otherwise agreed in writing, you will own the final deliverables we create for you (e.g. website, design files, custom code written specifically for your project). We retain the right to use general skills, tools, and pre-existing materials. We may showcase completed work in our portfolio unless you request otherwise.
5. Your content and obligations
You are responsible for providing accurate information, content, and access in a timely way. You warrant that you have the right to use any content you give us (text, images, branding, etc.). Delays caused by late or incomplete information may affect timelines and we are not liable for such delays.
6. Payment and cancellation
Payment terms will be set out in your quote or contract. We may require a deposit or staged payments. If you cancel a project, we may retain any deposit or fees for work already completed. Refunds are at our discretion unless required by law.
7. Limitation of liability
To the fullest extent permitted by law, our liability for any claim arising from our website or services is limited to the amount you have paid us for the relevant project in the 12 months before the claim. We are not liable for indirect, consequential, or punitive losses (e.g. lost profits, data loss), except where we cannot exclude such liability by law.
8. Confidentiality
We will keep your business and project information confidential and use it only to deliver the agreed work, unless you consent otherwise or we are required to disclose by law.
9. Changes
We may update these Terms from time to time. The “Last updated” date will be revised. Continued use of our website or services after changes constitutes acceptance. For active projects, the terms in place at the time of contract will apply unless we agree otherwise.
